Last updated: 1 January 2025
1. Acceptance of terms
By accessing or using DarkBlock (“the Platform”, “we”, “our”, “us”) you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Description of service
DarkBlock is a decentralised marketplace that enables creators to publish digital content and receive payment directly from buyers using the Sui blockchain. We provide the web interface, smart contracts, and supporting infrastructure — we are not a party to any transaction between creators and buyers.
3. Eligibility
You must be at least 18 years old to use the Platform. By using DarkBlock you represent that you meet this requirement and that you are not prohibited from using blockchain-based services under the laws of your jurisdiction.
4. Creator responsibilities
- You must own or have the necessary rights to all content you publish.
- You are solely responsible for the accuracy of pricing, descriptions, and file quality.
- You must not publish content that is illegal, defamatory, obscene, or infringes third-party intellectual property.
- You acknowledge that content uploaded to Walrus storage is permanent and cannot be deleted.
- You are responsible for all applicable taxes on income earned through the Platform.
5. Buyer responsibilities
- Purchases are final. Due to the on-chain nature of transactions, refunds are not possible unless the creator voluntarily provides one.
- An
AccessTicketgrants personal, non-exclusive access to the purchased content. Redistribution or resale is prohibited without explicit creator consent. - You are responsible for securing your wallet and session credentials. DarkBlock cannot recover lost access.
6. Fees
During the beta period DarkBlock charges 0% platform fees. Post-beta, the platform fee will be up to 10% of each transaction, deducted automatically by the smart contract at the time of purchase. Creators receive the remainder directly to their wallet. Fee changes will be announced at least 14 days in advance.
7. Prohibited conduct
You may not:
- Use the Platform to publish or transact in illegal content.
- Attempt to exploit, hack, or disrupt the smart contracts or web application.
- Impersonate other creators or misrepresent the origin of content.
- Use automated scripts to artificially inflate view or purchase counts.
- Use the Platform to launder funds or engage in fraudulent activity.
8. Intellectual property
Creators retain full ownership of their content. By publishing on DarkBlock, creators grant us a limited, non-exclusive licence to display content previews and metadata on the Platform for promotional purposes. This licence is revocable by removing your content from sale (note: files on Walrus remain stored permanently).
DarkBlock’s brand, logo, and website design are our intellectual property and may not be reproduced without permission.
9. Disclaimers & limitation of liability
The Platform is provided “as is” without warranties of any kind. We do not guarantee continuous availability, and we are not liable for losses arising from blockchain network failures, smart contract bugs, Walrus storage issues, or actions of third parties.
To the maximum extent permitted by law our aggregate liability to you shall not exceed the platform fees you paid in the 12 months preceding the claim.
10. Governing law
These terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation; failing that, through binding arbitration or the courts of competent jurisdiction.
11. Changes to these terms
We reserve the right to update these terms at any time. Continued use of the Platform after changes constitutes acceptance. Material changes will be communicated in advance via the Platform or by e-mail.
